Our litigation unit, which is part of the General Law Department, is well established and deals with most aspects of litigation, including motor vehicle accident and personal injury claims, commercial litigation, such as disputes arising out of contracts, banking law litigation, insurance law litigation, liquidations and consequences of insolvency, constitutional and administrative law litigation, general enforcement of contractual rights and delictual remedies. Depending on the circumstances, the urgency and the possibility of factual disputes, the litigation may be by way of action proceedings initiated by issuing a summons, or by way of application proceedings, initiated by a notice of motion with supporting affidavit.

The Transvaal Provincial Division of the High Court of South Africa has its seat in Pretoria and has jurisdiction over any defendant who resides or carries on business, or any cause of action which arises, in the area of the old Transvaal. We are therefore in a position to act as correspondent attorneys where necessary, or to undertake litigation directly without the costs associated with briefing correspondent attorneys, as is often necessary on account of jurisdiction.

Due to the nature of litigation, the complexity and prospective outcome of each matter will depend on its own circumstances and merits. Prospective clients are invited to contact any of the partners in the litigation unit of the General Law Department for a preliminary telephonic assessment with a view to setting up a consultation, if necessary.
