• Advising clients on, and litigation involving, general commercial, corporate and commercial matters;
• Employment law:
o Providing strategic advice to clients on all aspects of employment law;
o Advising clients on dismissals, unfair labour practices, incapacity and retrenchments:
i) Rendering assistance to clients prior to and during disciplinary action proceedings (disciplinary investigations, drafting of charge sheets, assisting initiators, representing management by initiating disciplinary enquiries, oversee fairness during proceedings, advise chairpersons during disciplinary inquiries, assist during disciplinary interviews, draft settlement agreements, etc.)
ii) Rendering assistance to clients during incapacity poor performance and ill health proceedings (investigations, assist with counseling / consultation process, incapacity hearing, incapacity dismissals, etc.)
iii) Rendering advice to clients relating to restructuring and retrenchment proceedings – facilitate Section 189 procedures
o Advising clients on restraints of trade, unfair competition and interpretation of contracts;
o All forms of employment litigation, including conducting disciplinary procedures;
o Advising clients on external dispute resolution proceedings and representing clients during CCMA / BC proceedings in dismissals and unfair labour practices;
o Drafting of various court applications, opinions on all aspects of employment law.
• Advising clients on, and litigation involving, consumer protection law.
• Advising clients on, and litigation involving, enforcement and protection of contractual and delictual rights;
• Advising clients on, and litigation involving, product liability, unfair business practices and consumer issues;
• Advising clients on, and litigation involving, restraints of trade and unlawful competition, both instituting and defending actions;
• Litigation involving personal injury claims arising out of motor vehicle accidents, medical malpractice, assault, actions of animals, ultra vires actions of the State, and cases of vicarious liability;
• Litigation involving professional negligence claims including those arising out of a failure to fulfill a mandate or to discharge a duty of care by legal professionals, doctors and hospitals.
